1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and GoToFast Technologies Ltd. ("GoToFast", "we", "us"), a company registered in Estonia. By creating an account or using any GoToFast service, you agree to these Terms.
2. The Service
GoToFast provides a web performance platform including CDN delivery, edge caching, DDoS protection, analytics, and related services ("Services"). We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at security@gotofast.biz if you suspect unauthorized access.
You must be at least 18 years old to create an account. Accounts may not be transferred without our prior written consent.
4. Acceptable Use
You agree not to use the Services to:
- Distribute malware, spyware, or other malicious software
- Conduct DDoS attacks, port scanning, or other network abuse
- Host or distribute illegal content
- Infringe intellectual property rights
- Send unsolicited bulk email (spam)
- Violate any applicable law or regulation
- Resell the Services without our express written permission
We reserve the right to suspend accounts that violate these policies without prior notice.
5. Payment Terms
Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law or as stated in our refund policy. If payment fails, we may suspend your account after a 7-day grace period. Prices may change with 30 days' notice.
6. Intellectual Property
GoToFast and its licensors own all intellectual property rights in the Services. These Terms do not grant you any right to use our trademarks, logos, or brand elements.
You retain ownership of all content you deliver through our network. You grant us a limited license to process, cache, and deliver that content solely to provide the Services.
7. Service Level Agreement
We target 99.9% monthly uptime for all paid plans (99.99% for Enterprise). In the event of downtime below the SLA target, customers are eligible for service credits as defined in our SLA documentation. Credits are the sole remedy for downtime.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTOFAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
Our total liability for any claim arising under these Terms shall not exceed the fees you paid to GoToFast in the 12 months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Services will cease and your data will be deleted within 90 days, except where retention is required by law.
10. Governing Law
These Terms are governed by the laws of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia, unless otherwise required by applicable consumer protection law in your jurisdiction.
